Section 6A
Can impose curfew
:
(1) If it is seen that there will be a disturbance of peace in any place, the Chief District Officer may, after considering the circumstances, issue a curfew order to define the boundaries of such place and impose a curfew so that no one can move around, assemble and do any other work in that place. While ordering the curfew, the chief district officer should publicize the order, the curfew area and the general public in the surrounding areas for information.
(2) After the issuance of the order in accordance with sub-section (1), no one other than a licensed person who has obtained a secret signal from the Chief District Officer shall move within the prohibited place and time.
(3) The police shall arrest the person who violates the curfew order and the police shall immediately present the arrested person before the Chief District Officer. The person so arrested may be punished with imprisonment up to one month or a fine of up to one thousand rupees or both, and the order of the punishment shall be appealed to the High Court, following the strict procedure deemed appropriate by the Chief District Officer.
(4) While ordering the curfew, the chief district officer may also order the police to shoot at the person or congregation breaking the curfew to control the curfew situation. In such a situation, if it is necessary for the police to shoot, before shooting, the police should use lathi charge, tear gas, water cannon or aerial fire against the curfew breaking person or the congregation according to the situation and if the curfew breaking person or the congregation does not leave, then the person or the congregation will be shot. The warning should be clearly understood. If the curfew-breaking person or the congregation does not leave despite such warnings, the police can shoot. But nothing written in this sub-section shall be deemed to prevent the Chief District Officer from giving orders to shoot any person or Jamaat who violates curfew by showing violent tendencies.
(5) The Chief District Officer shall issue an orderThe curfew period will be reduced by the same officer according to the situation and the curfew will be completely removed after the situation normalizes.
(6) After the chief district officer orders the curfew, the information about it should be given to the regional administrator and the Ministry of Home Affairs immediately.
